Welcome to Talubu. Talubu ("we", "us", or "our") is an educational games platform operated by Appidi Labs Ltd, a company registered in Cyprus. By accessing or using our website at talubu.com (the "Service"), you agree to be bound by these Terms of Service. If you do not agree, please do not use the Service.
1. Acceptance
By creating an account, joining a game, or otherwise using Talubu, you agree to these Terms of Service and our Privacy Policy. If you are using the Service on behalf of a school or organization, you represent that you have authority to bind that entity to these terms.
2. Description of Service
Talubu provides educational games for teachers and students. Teachers can create battles (single-game sessions) or marathons (multi-game sessions), customize games with word lists and settings, and share a 6-character code or link for students to join. Students join with a name only—no account required. The Service operates on a freemium model: free sessions support up to 5 participants; paid sessions (using credits) support up to 500 participants.
3. Account & Registration
Teachers must create an account to create and manage battles. Registration requires an email address and password, or sign-in via Google. You are responsible for keeping your credentials secure. Students participating in battles do not need to register; they provide a display name when joining.
4. Credits & Payments
Paid battles require credits. Credits can be purchased in packs (e.g. 5, 12, or 25 credits). Each paid battle consumes 1 credit. Payments are processed by Stripe. Prices are VAT-inclusive (Cyprus). You may save a payment method for future purchases. Refunds are handled in accordance with applicable consumer law and our refund policy. Unused credits do not expire but are non-refundable except where required by law.
5. Acceptable Use
You agree to use the Service only for lawful, educational purposes. You must not: (a) upload or share content that is offensive, harmful, or inappropriate for educational settings; (b) attempt to circumvent security, credits, or participant limits; (c) use the Service to harass, bully, or harm others; (d) resell or commercially exploit the Service without our permission. We may suspend or terminate accounts that violate these terms.
6. Intellectual Property
Talubu, our platform, games, and branding are owned by Appidi Labs Ltd. You may not copy, modify, or distribute our content without permission. Teachers retain ownership of any custom content (e.g. word lists, questions) they create. By using the Service, you do not grant us ownership of your content beyond the license we need to operate the Service.
7. User Content
When you create battles with custom words, questions, or other content, you grant us a limited license to store, use, and display that content solely to provide the Service. You are responsible for ensuring your content complies with these terms and does not infringe third-party rights. We may remove content that violates our policies.
8. Privacy
Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your data. By using the Service, you consent to the practices described in the Privacy Policy.
9. Disclaimer
The Service is provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that the Service will be uninterrupted, error-free, or secure. We are not responsible for the accuracy or content of user-created materials.
10. Limitation of Liability
To the maximum extent permitted by law, Appidi Labs Ltd shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill arising from your use of the Service. Our total liability shall not exceed the amount you paid us in the twelve months preceding the claim. Some jurisdictions do not allow exclusion of certain warranties or limitations of liability; in such cases, our liability is limited to the fullest extent permitted by law.
11. Termination
We may suspend or terminate your account at any time for violation of these terms or for any other reason. You may close your account at any time. Upon termination, your right to use the Service ceases. Unused credits are non-refundable. Data associated with your account may be retained or deleted in accordance with our Privacy Policy.
12. Changes
We may update these Terms of Service from time to time. We will notify you of material changes by posting the updated terms on the Service and updating the "Last updated" date. Your continued use of the Service after such changes constitutes acceptance of the updated terms. If you do not agree, you must stop using the Service.
13. Governing Law
These Terms of Service are governed by the laws of Cyprus. Any disputes arising from these terms or the Service shall be subject to the exclusive jurisdiction of the courts of Cyprus.
